MCS & Superior Court
Got a traffic ticket. Trying to get the Court to allow me to take traffic school online instead of going to class in person. This is shaping up to be a quite a challenge. Wonder how the Americans With Disabilities Act (ADA) may be able to help me? Any lawyers out there in Curezone Land?
Date: 9/29/2008 10:01:43 PM ( 16 y ) ... viewed 2922 times I was supposed to go away for a couple of days for Rosh Hashanah (Jewish New Year) but felt too ill today so stayed home and wrote a letter to my county Superior Court. I got a traffic ticket a couple of weeks ago and didn't have the energy to fight it. The Superior Court said I could go to traffic school to get the ticket off of my record but they don't allow you to take the course online.
The letter I wrote requests taking the course online due to my disability--it took me on and off all freeking day to compose it--it took more energy than if I'd gone to traffic court and thrown myself on the mercy of the judge in the first place. Don't know how this is gonna pan out--the courts often talk big about access for people with disabilities then don't always follow through. I did phone a woman who is an advocate for the disabled in court and she said she'd hand-carry my letter to the Superior Court judge for me! It's a start, anyway!

Attention: Judge of the Superior Court, Traffic Violations
Your Honor:
The Superior Court granted my request to attend county traffic school for a traffic violation. When contacting the County-contracted traffic school, I requested that I be allowed to take the traffic school course online rather than in a designated classroom secondary to my disability. I was told they could not accommodate me and they recommended I make this request of the Judge of the Superior Court.
I am disabled secondary to the following medical conditions: fibromyalgia, chronic fatigue, and MCS (multiple chemical sensitivity). Fibromyalgia makes it difficult for me to tolerate sitting for an extended period of time without pain or discomfort; chronic fatigue further limits my ability to participate in any sustained activity and compromises my ability to concentrate over long periods of time. My ability to participate in a given activity is usually limited to about 2 hours at a time before I need to rest; this is on a day when I feel relatively well. My tolerance for activity is even less if I am feeling unwell. My ability to participate in any given activity fluctuates from day to day and there is no predictability when I will be having a “good” day vs. a “bad” day.
MCS causes me extreme sensitivity to particular chemicals and toxins in the environment. The substances that I may be exposed to in a classroom setting that would cause me distress include, but are not exclusive to, perfumes and scented products worn by other participants/instructors such as aftershave lotion, hand and body lotions, hair spray, hair gel, cologne, deodorant, laundry product residues in clothing; commercial cleaning products—floor wax, floor cleaner, air fresheners, furniture polish, aerosol products of any kind; products releasing formaldehyde or VOC’s such as new carpeting or furniture or new paint/varnishes or other construction materials; pesticides; mold or dust in air ducts; or any number of other toxins commonly found in a closed building environment. Exposure to these substances causes migraine-type headaches, mood swings, dizziness, nausea, sinus and throat irritation, difficulty breathing, and exacerbates symptoms of fibromyalgia and chronic fatigue such as joint, muscle and nerve pain and stiffness, muscle weakness, confusion, short term memory loss and fatigue.
I believe that secondary to my disability I can not be accommodated in a traffic school classroom environment. I am requesting that I be allowed to take the traffic course online through a court-approved traffic school. An online course would allow me to learn at home in an environment free of chemical toxins and at my own pace in accordance with my other limitations. If necessary, I am willing to pay extra costs in addition to the traffic school fees I already remitted to the Superior Court.
Enclosed is a copy of my Traffic School Notice, a copy of the disability decision made by the Administrative Law Judge for the Social Security Administration and a note from my physician confirming my diagnoses and disability.
